Organisations and communities will continue their fight against db’s greed

The Court of Appeal today ruled that there were not enough grounds for a retrial in the planning case regarding the DB Group ITS development in Pembroke.

We take note of the judgment and are considering further avenues to defend the wellbeing of residents and the residential amenity of the locality. This development will result in a monstrous impact blocking out sunlight and creating traffic havoc.

We highlight the fact that both the Tribunal and the Court of Appeal have ruled that no business or activity may operate from the site until Transport Malta certifies that the infrastructure is adequate to sustain such an intensive development. The Court of Appeal said that there will be consequences if this is not provided.

We are holding Transport Malta to this, although we do not have any faith in the authorities – the same authorities which have not put a stop to the tipper trucks being parked facing the wrong way, on pavements, on double yellow lines, bus stops and “at every corner” of Pembroke at all times of the day. These are the same authorities which have not put a stop to the DB takeover of a public square in Mellieħa. These are the same authorities which are allowing the same company take over a beach in Qawra.

The authorities refuse to enforce any conditions and do not protect residents or the public.We will hold these authorities to account – come what may.

The fight continues.

Għaqdiet u komunitajiet ser ikomplu l-ġlieda tagħhom kontra r-regħba tad-db

Dalgħodu l-Qorti ċaħdet it-talba tagħna, ta’ għaqdiet oħra, ta’ tliet Kunsill Lokali, u ta’ bosta residenti ta’ Pembroke, sabiex jitħassar il-permess għall-proġett mostruż tad-DB Group f’Pembroke.

Art pubblika f’żona residenzjali ngħatat lill-privat sabiex fuqha jinbnew żewġ torrijiet ta’ 17 u 18-il sular, u lukanda ta 12-il sular, li ser jidfnu taħthom il-lokalitajiet tal-madwar.

Ir-residenti ta’ Pemborke diġà bdew iġarrbu l-arroganza tad-DB b’invażjoni kontinwa u bla rispett ta’ trakkijiet u trabijiet. U sadanittant id-DB qed ikompli illegalment jaħtaf postijiet pubbliċi, bħal pereżempju l-pjazza tal-Mellieħa u x-xatt tal-Qawra, bil-barka tal-awtoritajiet.

Bl-azzjoni legali tagħna f’dan il-każ, tlabna li tinbidel is-sentenza tal-Qorti tal-Appell għaliex, minkejja li din tatna raġun fuq il-fatt li l-awtoritajiet ma mxewx mal-liġi meta injoraw il-Pjan Lokali, il-Qorti tal-Appell kienet naqset milli tħassar il-permess tad-DB.

Il-ġlieda ta’ bosta gruppi u komunitajiet kontra r-regħba tad-DB Group ilha sejra għal dawn l-aħħar seba’ snin. L-organizzazzjoni b’saħħitha tal-poplu kontra dan il-monument għar-regħba hija ta’ ispirazzjoni għall-bqija tal-pajjiż.

Għalhekk illum bilfors ikollna nesprimu d-diżappunt tagħna għal din id-deċiżjoni tal-Qorti. Nibqgħu konvinti li dan huwa proġett diżastruż li ser jgħarraq il-kwalità tal-ħajja tagħna u jħaxxen il-bwiet tal-ftit. Min ħa deċiżjonijiet jintnu dwar it-trasferiment tal-art u l-permessi għall-iżvilupp, irid iġorr bis-sħiħ ir-responsabbiltà għal din l-inġustizzja mal-poplu.

Aħna xorta ser nibqgħu nagħmlu ħilitna sabiex inwaqqfu li ssir din il-ħsara lil pajjiżna. Infakkru kif, wara l-azzjonijiet legali tagħna, issa l-proġett ser ikun jista’ jopera biss jekk jingħata ċertifikat li l-infrastruttura tiflaħ għat-traffiku li ser joħloq. Dan għaliex il-proġett ġie approvat abbażi ta’ pjanijiet vagi għal tiġdid fl-infrastruttura. Minn dak iż-żmien ‘l hawn, dawn il-pjanijiet lanqas biss għadhom jeżistu.

Ser inkomplu wkoll infittxu rotot legali sabiex jitħassar il-permess għal dan il-monument għar-regħba.
